Terms and Conditions ("Terms")

Please read these Terms and Conditions ("Terms", "Terms and Conditions") carefully before using the https://www.besisufit.trainingtilt.com) website and the "Service" operated by Be Sisu Fit Inc.. Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service.

By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service.

Definitions

In this document the following words shall have the following meanings:

"Buyer" means the organization or person who buys Services

"Goods" means the articles to be supplied to the Buyer by the Seller;

"Intellectual Property Rights" means all patents, registered and unregistered designs, copyright, trademarks, know-how and all other forms of intellectual property wherever in the world enforceable;

"Seller" means Be Sisu Fit Inc.

General

These Terms and Conditions shall apply to sales of Goods by the Seller to the Buyer to the exclusion of all other terms and conditions referred to, offered or relied on by the Buyer whether in negotiation or at any stage in the dealings between the parties, including any standard or printed terms tendered by the Buyer, unless the Buyer specifically states in writing, separately from such terms, that it wishes such terms to apply and this has been acknowledged by the Seller in writing.

Any variation to these Terms and Conditions (including any special terms and conditions agreed between the parties) shall be inapplicable unless agreed in writing by the Seller.

Payments

Fees

You will pay all fees specified in Order Forms. Fees are based on Services and Content subscriptions purchased and not actual usage (Buyer cannot get a refund for the services if they have not used the service. It is Buyer’s responsibility to use the service and Be Sisu Fit Inc. is not obligated to issue a refund if the Buyer claims he/she has not benefited from the service if he/she has not used the Service.)

Payment in full is required before your package will be delivered.

All Credit Cards will be processed in US Dollars at the time of payment. Be Sisu Fit Inc. is not responsible for any fees, charges, exchange rates, or additional charges or taxes levied by individual financial institutions, countries, or Credit Card companies.

Purchases

If you wish to purchase any product or service made available through the Service ("Purchase"), you may be asked to supply certain information relevant to your Purchase including, without limitation, your name, address, phone number, email address.

Subscriptions

Some parts of the Service are billed on a subscription basis ("Subscription(s)"). You will be billed in advance on a recurring basis for the upcoming month.

Cancellation of services

1 ) by the Buyer. We require that the Buyer allows us 7 days' notice of cancellation of your service. If Buyer is unable to continue with the coaching service Buyer has subscribed to and provides us a reasonable explanation on why Buyer cannot continue with the coaching service and provides us a written Cancellation/& Refund Request, we offer refund whatever is remaining of the subscription. For example, if Buyer has paid for a full 12-month service and needs to cancel due to unforeseen circumstances after 9 months, we will refund Buyer the remaining. We will not refund passed services. Any refund for Coaching Service Packages will be an exclusive one-time assessment fee of USD 55 and a software license fee of USD 6. Any payment made to you will be made in USD via PayPal. You will be responsible to pay fees due to Currency conversion.

2 ) By Be Sisu Fit Inc. Be Sisu Fit Inc. may limit, suspend, or stop providing the Services to the Buyer if Buyer fails to comply with these Terms (such as failure to pay fees when due), or if Buyer uses the Services in a way that causes legal liability to us or disrupts others' use of the Services. Be Sisu Fit Inc. may also suspend providing the Services to Buyer if we are investigating suspected misconduct by you. If we suspend or terminate the Services Buyer receives, we will endeavor to give you advance notice and an opportunity to pay any due fees. Be Sisu Fit Inc. has no obligation to retain your Content upon termination of the applicable Service.

Refunds on Services (excl. coaching services)

Given the nature of digital content, we do not automatically offer a refund. We will assess refund or credit requests on their merits. There is generally no obligation to provide a refund or credit in situations like the following:

a. You have changed your mind about a service;

b. You bought the service by mistake;

c. You do not have sufficient expertise to use the service;

d. You ask for goodwill, or e. You can no longer access the service because it has been removed (we advise you to download items as soon as you buy them to avoid this situation).

We do understand sometimes you may not be fully satisfied with our service and we do everything we can to prevent that to happen. We kindly ask your understanding of this issue as this service is customized to fit your needs and is based on the individual assessment we go through before the service is provided to you. Bearing this in mind, please take your time to truthfully answer the assessment questions we base our programming on.

Content

Be Sisu Fit Inc. reserves all its rights in www.besisufit.trainingtil..com content and online services. Nothing in the Terms grants you a right or license to use any of the content owned by Be Sisu Fit Inc. except as expressly provided in the Terms.

Your personal Information

Information about you will be collected in order to design an effective, safe, and individualized training program. This information will not be shared or released to any other person or company and is kept secure in our File Systems in the computer and physical office.

Links To Other Web Sites

Our Service may contain links to third-party web sites or services that are not owned or controlled by Be Sisu Fit Inc. Be Sisu Fit Inc. has no control over and assumes no responsibility for, the content, privacy policies, or practices of any third-party web sites or services. You further acknowledge and agree that Be Sisu Fit Inc. shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such web sites or services.

THE WAIVER

You, the Client/Guardian, are aware that there are risks associated with participating in fitness/sports activities and exercise. Your participation is completely voluntary, and you freely accept and fully assume all responsibility for all risks, and all possibilities of personal injury, death, property damage, or loss to yourself or any other person as a result of your participation in fitness activities.

You and your heirs, next of kin, executors, administrators and assigns agree: a) to waive all claims, known or unknown, that you have or may have in the future against the Be Sisu Fit Inc., including their owners, officers, directors, agents, employees, volunteers, business operators, independent contractors and site property owners b) that the Be Sisu Fit Inc. is not liable or responsible for any damage to, loss or theft of your property; c) to release and forever discharge the Be Sisu Fit Inc. from all liability for any personal injury, death, property damage or loss resulting from your participation in fitness activities due to any cause, including but not limited to negligence (failure to use such care as a reasonably prudent and careful person would use under similar circumstances), breach of any duty imposed by law, breach of contract or mistake in error of judgment of the Be Sisu Fit Inc.; and d) to be liable for and to hold harmless and indemnify the Be Sisu Fit Inc. from all actions, proceedings, claims, damages, costs demands, including court costs on a solicitor and own client basis, and liabilities of whatsoever nature or kind arising out of or in any way connected with your participation in fitness activities.

By continuing with the purchase of the service/product provided by Be Sisu Fit inc, you agree to this waiver

Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is a material we will try to provide at least 30 days' notice on our website prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
